If you reside in the United States and were notified by Alabama Ophthalmology that your Private Information may have been impacted in the January 2025 targeted cyberattack on Alabama Ophthalmology Associates, P.C. computer systems, “Data Incident”, then you may be a Settlement Class Member and eligible for benefits. Excluded from the Settlement Class are: Alabama Ophthalmology; any entity in which Alabama Ophthalmology has a controlling interest, is a parent or subsidiary, or which is controlled by Alabama Ophthalmology; and the affiliates, legal representatives, attorneys, heirs, predecessors, successors, and assigns of Alabama Ophthalmology. Also excluded are the judges and court personnel in this case and any members of their immediate families.
If you are a Settlement Class Member and wish to receive Settlement Benefits then you must submit a Claim Form by July 6, 2026.
All Settlement Class Members may claim Medical Data Monitoring and Identity Theft Protection services, and one of two cash payment options. The benefits are explained in more detail below.
Medical Data Monitoring and Identity Theft Protection: Settlement Class Members who submit valid claims may enroll in two (2) years of CyEx Medical Shield Complete. This comprehensive service comes with $1 million of medical identity theft insurance, and includes monitoring for:
- healthcare insurance ID exposure
- Medical Record Number (MRN) exposure
- unauthorized Health Savings Account (HSA) spending
If anything suspicious happens, you will be able to talk to a fraud resolution agent to help fix any problems.
Payment Option 1 - Out-of-Pocket Expense Claims: If you incurred actual, documented out-of-pocket losses due to the Data Incident, you can get back up to $5,000.00. The losses must have occurred between January 22, 2025, and July 6, 2026. This benefit covers out-of-pocket expenses like:
- losses because of identity theft or fraud
- fees for credit reports, credit monitoring, or freezing and unfreezing your credit
- cost to replace your IDs
- postage to contact banks by mail
You need to send proof, like bank statements or receipts, to show how much you spent or lost. You can also send notes or papers you made yourself to explain or support other proof, but those notes or papers alone are not enough to make a valid claim. Your proof or notes should show that your expenses were because of the Data Incident.
You cannot claim a payment for expenses that have already been reimbursed by a third party.
Payment Option 2 - Pro Rata Cash Payment. Instead of Out-of-Pocket Expense Claims, you may claim a one-time pro rata cash payment, estimated at $60.00 but may be larger or smaller depending on the total valid claims filed. You do not have to provide any proof or explanation to claim this payment.

The deadline to submit a Claim Form online is July 6, 2026. If you are mailing your Claim Form, it must be mailed with a postmark date no later than July 6, 2026.
